Seller terms

These terms apply if you open a shop on Kinkmarket, list in the Kinkmarket directory, or earn Kredits on Kinkmarket. They sit alongside our Terms of use, which also apply to you. Kinkmarket is run by KCTECHNOLOGY Ltd (company number 17302910), 66 Paul Street, London EC2A 4NA (“we”, “us”).
These policies are part of these terms: Content policy, AI policy, Cash-out policy, Age verification policy, Privacy policy, and, if you take part, the Refer and Earn terms. If anything in these terms conflicts with the Cash-out policy on how cash-out works, these terms apply.
1. Who can sell
- You must be 18 or over and legally able to enter into these terms.
- You must complete an identity check with our verification provider, Didit, before your first listing goes live. If you apply for a directory listing, the check happens when you apply. You cannot sell until the check has passed. See section 6 for the separate check before your first cash-out.
- The details you give us must be true and your own. One person or business per account unless we agree otherwise in writing.
- If your account is an AI persona, you must say so when you sign up, and a real, verified person or company must operate it and be responsible for it. The AI policy applies in full.
- You are selling on your own account, as an independent seller. Nothing in these terms makes you our employee, agent or partner.
2. Your shop and listings
- You decide what to sell, your prices and your postage, within our rules.
- Everything you list must be your own, accurately described, and legal to sell. Anyone who appears in your photos or content must be an adult who has consented.
- Your shop, listing photos and previews must be safe for work, as set out in the Content policy. Explicit content is never shown on your shop or sent through Kinkmarket messages.
- Images you upload to Kinkmarket have a Kinkmarket watermark added to protect them from being copied.
- You give us a non-exclusive, worldwide, royalty-free permission to host, show, resize, watermark and promote your shop, listings and images on Kinkmarket and in our own marketing of your shop, for as long as they are on Kinkmarket. We will only feature you on our social media if you said yes to that. You keep ownership of your content.
3. Consent and records for everyone in your content
- Everyone who appears in your content was 18 or over when it was made, gave their free and informed consent to its creation and to its sale through Kinkmarket, and has not withdrawn that consent.
- You keep records proving the identity and age of everyone who appears in your content, including a copy of their government-issued photo ID and the date the content was made, for as long as the content is available and for at least 7 years afterwards. You will give them to us, our payment partners or a relevant authority promptly if asked.
- If anyone withdraws consent, you remove the content straight away.
4. How buyers pay you
Kredits. Every shop accepts Kredits, and you cannot switch them off. Buyers buy Kredits from us. Ten Kredits are worth £1 to spend, so an item priced at £10 costs the buyer 100 Kredits. When a buyer pays you in Kredits for an order, an instant unlock or a tip, those Kredits are added to your earnings straight away.
Your own payment methods. You can also let buyers pay you directly by methods such as PayPal, bank transfer, Revolut, Amazon gift card or Throne. The details you enter are shown to buyers at checkout. Those payments go straight from the buyer to you. We do not handle them, we cannot see or recover them, and you are responsible for them, including any disputes, and for following the rules of the payment service you use.
5. Orders, delivery and customer service
- You are the seller of every physical item and service you list. Your contract for it is with the buyer.
- You must send items promptly to the address the buyer gives, as described, and keep proof of postage.
- You must answer buyers’ questions and complaints promptly through Kinkmarket messages, and deal with returns, faults and disputes yourself.
- If you sell as a business, consumer law gives your buyers rights, including in most cases a 14 day right to cancel an order made online. You are responsible for meeting those obligations.
- If an order paid in Kredits is not sent, or there is a problem with it, we can hold your earnings on that order until it is sorted out.
6. Kredits, earnings and cash-out
- What your earnings are worth. When you cash out, each earned Kredit is worth 8p to you, which is 80% of its 10p spending value. The difference covers payment processing and the cost of running Kinkmarket. So 500 Kredits pays £40.00 and 1,000 Kredits pays £80.00.
- The minimum. You can cash out once you have at least 500 Kredits. You choose how many to cash out, from 500 up to your whole balance.
- How and when. We pay by bank transfer, to a UK account or an international account by IBAN, within 7 days of your request. You can have one cash-out in progress at a time. The Kredits you ask to cash out are taken from your balance when you ask, so they cannot be spent by mistake.
- Identity. Before your first cash-out you complete a one-off identity check with Didit. This is a legal and anti-fraud requirement.
- Your bank details. They are encrypted and used only to pay you. We never show them to anyone else.
- Only earned Kredits can be cashed out. Kredits you buy for yourself are for spending on Kinkmarket, for example on Hub Pro or on featuring your shop, and cannot be cashed out.
- Holds and corrections. We may hold a cash-out, or the earnings on an order, if an order paid in Kredits has not been sent, until it is sorted out. We may also hold or cancel a cash-out, or take Kredits back out of your balance, if they came from a purchase that was charged back or found to be fraudulent, from a breach of these terms, or from our own mistake. Where we do, we will tell you why.
- Rates can change. We may change the cash-out rate or the minimum by updating the Cash-out policy. The rate that applies is the one shown on your Your Kredits page when you make the request.
- Tax. What you earn is your income. You are responsible for reporting it and paying any tax due. We do not deduct tax for you.
7. Plans and fees
Founding shops. Shops that join under our founding offer pay nothing for their first 6 months. After that the shop plan is £14.99 a month. Any other shop pays the price shown when it signs up and on its account page.
Hub Pro. Hub Pro, our paid seller plan, is £14.99 a month. You can pay:
- monthly by Direct Debit, which renews each month until you cancel;
- for a block of 1, 3, 6 or 12 months in advance, by bank payment or with Kredits. Blocks of 6 months are 10% off and 12 months are 15% off. A block ends on its end date and does not renew by itself.
Paid directory listings. A basic directory listing is free. Featured is £9.99 a month and Featured Plus is £19.99 a month, paid monthly and renewing each month until you cancel.
Cancelling. There is no minimum contract. You can cancel a monthly plan at any time by emailing [email protected], and it stops at the end of the month you have paid for. Money already paid for a month or a block is not refunded when you cancel early.
If you stop paying. We will remind you before a payment is due. If a payment is not made by the due date, we may lock your access to the Hub and to the tools that come with your plan until it is paid, and restore it once you pay.
Price changes. We may change our prices. We will give you at least 30 days’ notice by email before a new price applies to you.
8. Referrals
If you share your shop link and earn referral rewards, the Refer and Earn terms apply. Referral rewards are paid in Kredits.
9. What we can do if these terms are broken
We may remove a listing, suspend or close your shop, hold or cancel a cash-out, or take back Kredits as set out in section 6, if we reasonably believe you have broken these terms, the Terms of use or our policies, or if the law requires it. For anything in the legal baseline of the Content policy, or any use of an unauthorised likeness or depiction of a minor under the AI policy, we act immediately and report to the relevant authorities. Where it is lawful and sensible, we will tell you why, and you can ask us to look at the decision again by emailing [email protected].
10. Closing your shop
You can close your shop at any time by emailing [email protected]. Before you close it, send any orders that are already paid. If you have 500 Kredits or more in earnings, you can cash them out first.
11. Responsibility
You are responsible for your shop, your content, your items, your dealings with buyers and your compliance with the law. You agree to cover our losses, costs and penalties caused by your breach of these terms, or by a claim that your content breaks the law or someone else’s rights.
We provide Kinkmarket as it is. We do our best to keep it running, but we cannot promise it will always be available. We are not responsible for lost profits or lost sales. Apart from money we owe you under section 6, our total responsibility to you in any 12 months is limited to the fees you paid us in that period. Nothing in these terms limits liability that the law does not allow us to limit, including for death or personal injury caused by negligence, or for fraud.
12. Changes
We may update these terms. We will tell you by email at least 14 days before a change that significantly affects you takes effect. If you keep selling after that, the new terms apply. If you do not agree, you can close your shop before the change takes effect.
13. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
