Terms of use

These terms govern your use of kinkmarket.me (“Kinkmarket”, “we”, “us”). Kinkmarket is operated by KCTECHNOLOGY Ltd (company no. 17302910), trading as Kinkmarket. Our service address is KCTECHNOLOGY Ltd, 66 Paul Street, London, EC2A 4NA. You can reach us at legal@kinkmarket.me.

By using this website you agree to these terms. If you do not agree to them, do not use the site.

1. You must be 18 or over

Kinkmarket is intended only for adults. By entering and using the site you confirm that you are 18 years of age or over. If you are under 18, you must not use this site.

2. What Kinkmarket is

Kinkmarket is a marketplace and a directory.

For digital content, such as media, pay-per-view content, memberships, tips and Kredits, Kinkmarket is a marketplace: these are bought and delivered through Kinkmarket, and payment is taken through our third-party payment processor. Kinkmarket is not the creator and does not produce the content; the creator is responsible for the content they sell.

For physical items, Kinkmarket is a directory: it indexes independent adult creators who run their own storefronts. No card payment is taken on the site for physical items, and payment, delivery and any dispute or refund for a physical item are arranged directly between the buyer and the creator.

3. Digital content and external storefronts

Kinkmarket hosts and delivers the digital content that is sold on the site, such as media, pay-per-view content and memberships, through creators’ profiles on Kinkmarket. Physical items are directory listings only: for those, Kinkmarket links to creators’ own external storefronts, and when you follow such a link you leave our site and the creator’s own terms apply.

4. Payments, delivery and refunds (digital content)

When you buy digital content, a membership, or Kredits on Kinkmarket, payment is processed securely by our third-party payment processor and the purchase is delivered to you through Kinkmarket. Your statement will show a descriptor for the transaction.

Digital content, memberships and Kredits are delivered as soon as your payment is confirmed. Because they are delivered immediately, these purchases are final and non-refundable once the content has been accessed or the Kredits used, except where a refund is required by law, or where the content is faulty, materially not as described, or was not delivered. If you have a problem with a digital purchase, contact us at legal@kinkmarket.me and we will put it right.

Physical items are not sold through Kinkmarket. Any payment, delivery, dispute or refund for a physical item is solely between you and the creator.

5. Creator listings

To be listed on Kinkmarket, a creator must run their own storefront and must be vetted by us as part of onboarding. Vetting is a manual review carried out by the operator. It includes confirmation that the creator is over 18, confirmation of their existing presence in the adult creator space, and confirmation that their storefront will comply with our Content policy.

Listing is at our discretion. We may decline, suspend or remove any listing at any time, including for breach of our Content policy.

6. AI creators and AI-generated content

Some creators listed on Kinkmarket are AI personas rather than real individuals. That is allowed, and it is always disclosed. An AI creator carries an AI label on their profile and listings so you always know what you are buying and who you are talking to.

Every AI creator has a named operator behind it, being a real person or company who is accountable for the account and who must verify their identity with us. Creators must tell us truthfully at sign up whether an account is an AI persona.

Where a real creator uses AI to enhance their photography, those images must still show that same real, identity-verified creator. Using AI to turn an image into a different or fictitious person is not permitted, and neither is using AI to imitate anyone else.

We may label, restrict or remove any listing or account where we reasonably believe this section has been breached, or where a creator’s declaration is inaccurate.

7. Buyer accounts

You can register a buyer account on Kinkmarket. An account lets you message creators, save preferences, and move between creators’ storefronts without re-registering. Registration is free.

When you register, you confirm that you are 18 or over and that the information you provide is accurate. You are responsible for keeping your password confidential and for everything that happens under your account. If you believe your account has been used without your permission, contact us at legal@kinkmarket.me.

You may close your account at any time. When you close your account, we remove your account record. Some information may be retained for a limited period where the law requires it, or where it is needed to deal with a dispute, abuse report, or legal claim.

8. Messages between buyers and creators

Kinkmarket provides a private messaging system that lets registered buyers and creators talk to each other. The same rules in these terms and in the Content policy apply in messages as on the rest of the site.

Messages are intended for buyers to ask questions, agree custom orders, and arrange delivery. They are not a channel for delivering pornographic content. Creators who wish to send a buyer explicit content after a purchase do so off Kinkmarket, using their own private channel.

Messages between two parties are private to those parties. We do not routinely read them. We will review specific threads where one party reports the other, where law enforcement requires it, or where there is reasonable cause to believe these terms or the Content policy have been breached.

You can block another user or report a thread from inside the conversation. Reports are reviewed by the operator.

9. Acceptable use

When using Kinkmarket you agree not to:

• use the site if you are under 18, or attempt to bypass the age confirmation;
• access the site by automated means, scrape it, or copy its contents without our permission;
• interfere with the site’s operation or security;
• send unlawful, abusive, harassing, deceptive or infringing material through any channel on the site, including the messaging system;
• send pornographic content through the messaging system;
• impersonate another person, or misrepresent your identity, your eligibility, or your relationship to a creator;
• register more than one account, or register an account on behalf of someone else, without our permission.

10. Suspension and termination

We may suspend or terminate any account, and remove any listing, where we have reasonable grounds to believe a user has breached these terms or the Content policy, or where doing so is required by law. For serious breaches, including anything in the legal baseline of the Content policy, suspension is immediate and content is reported to the relevant authorities.

If your account is suspended or terminated, you will be told the reason where it is appropriate and lawful to do so.

11. Links to creator storefronts (physical items)

For physical items, Kinkmarket links to third-party storefronts operated by independent creators. We do not control those storefronts and are not responsible for their content, their products, their terms, or your dealings with them. Following a link is at your own discretion.

12. No warranty

The site is provided “as is”. We do not warrant that listings are accurate, complete or currently available, and we make no warranty about any creator, storefront, product or service indexed on the site. Curation and review reduce risk; they are not a guarantee.

13. Limitation of liability

To the fullest extent permitted by law, Kinkmarket is not liable for any loss or damage arising from your use of the site, from your reliance on any listing, or from any dealing between you and a creator, including any physical-item transaction arranged directly with a creator. For a digital purchase processed through Kinkmarket, our total liability is limited to the amount you paid for that purchase. Nothing in these terms excludes or limits liability that cannot be excluded or limited under the law of England and Wales, including liability for death or personal injury caused by negligence, or for fraud.

14. Changes to these terms

We may update these terms from time to time. The date at the top of this page shows when they were last changed. Continued use of the site after a change means you accept the updated terms.

15. Governing law

These terms, and any dispute arising from them or from your use of the site, are governed by the law of England and Wales and subject to the exclusive jurisdiction of its courts. Kinkmarket is accessible internationally, but it is operated from the United Kingdom. If you access the site from outside the United Kingdom, you are responsible for complying with the laws that apply to you.
