Terms of use

These terms apply to your use of kinkmarket.me (“Kinkmarket”, “we”, “us”). Kinkmarket is run by KCTECHNOLOGY Ltd, a company registered in England and Wales (company number 17302910), trading as Kinkmarket. Our address is KCTECHNOLOGY Ltd, 66 Paul Street, London EC2A 4NA. By using Kinkmarket you agree to these terms. If you do not agree, please do not use the site. If you sell on Kinkmarket, our Seller terms also apply to you.

1. You must be 18 or over

Kinkmarket is for adults only. By using it you confirm you are 18 or over. Before you can see or buy adult content, we will ask you to complete an age check through our verification provider, Didit. Our Age verification policy explains how this works.

2. What Kinkmarket is

Kinkmarket is a platform, just a friendly one. Independent adult creators (“sellers”) open shops here, list physical items, digital content and services, and talk to their buyers. We run the site, the accounts, the messaging, the checkout and the Kredits that buyers use to pay. Sellers make, own and are responsible for what they sell.

Some sellers also have a free or paid directory listing that links to their own website. When you follow one of those links you leave Kinkmarket, and that website’s own terms apply.

3. Kredits

Kredits are Kinkmarket’s own currency. They are sold by KCTECHNOLOGY Ltd.

• Price and value. Ten Kredits are worth £1 to spend on Kinkmarket. When you buy Kredits a 10% processing fee is added, so each Kredit costs 11p. The price shown on each pack is the full amount you pay.
• How you pay. You can pay by card, taken on a secure page run by our card processor, Fynex (Fondy), or by bank payment through GoCardless where it is available in your country. We never see or store your card number. Your statement shows the charge as KCTechnology and nothing about what you bought.
• What they are for. You can use Kredits to tip creators, to unlock instant digital content, to pay for items in a seller’s shop, and for other features we show a Kredit price on.
• What they are not. Kredits you buy have no cash value. They cannot be exchanged for money, transferred to another account or withdrawn. Only sellers can cash out Kredits, and only Kredits they have earned, under our Cash-out policy.
• Delivery. Kredits are added to your balance as soon as your payment is confirmed.
• Chargebacks. If you dispute or charge back a Kredit purchase, we may remove the matching Kredits from your balance and suspend your account while we look into it.

4. Buying on Kinkmarket

Physical items. When you check out in a seller’s shop, you choose how to pay. There are two kinds of payment.

• Kredits. You pay from your Kredit balance and the order is marked paid straight away. The Kredits go to the seller’s earnings, which the seller can only cash out after a delay. This gives us time to act if an item is not sent.
• The seller’s own payment methods, such as PayPal, bank transfer or Revolut. You pay the seller directly. We do not take, hold or see that payment, and we cannot recover it for you.

Whichever way you pay, your contract for a physical item is with the seller, not with us. The seller is responsible for describing the item accurately, posting it to the address you give, and dealing with any problem with it. Postage and any other charges are shown before you confirm your order.

Instant content and tips. When you unlock instant digital content or tip a creator, you pay in Kredits and the content, or your tip, is delivered straight away.

Custom orders and services. Where a seller offers custom content or a service, what you get and when is agreed between you and the seller. Explicit content is never delivered through Kinkmarket messages. Our Content policy explains this.

5. Your rights and what happens if something goes wrong

Nothing in these terms affects your legal rights as a consumer.

• Kredits. Kredits are added to your balance as soon as your payment is confirmed. Any legal right you have to cancel an online purchase, including within 14 days, is not affected by these terms.
• Digital content. If digital content you paid for is faulty, not as described, or was not delivered, you have rights under the Consumer Rights Act 2015. Tell us at [email protected] and we will look into it and tell you what we will do.
• Physical items. Your rights for a physical item are against the seller. If the seller is selling as a business, you may have the right to cancel within 14 days of receiving the item, and the right to a remedy if the item is faulty or not as described. Some items can be excluded from cancellation, such as personalised or made to order items, and sealed items that are not suitable for return for hygiene reasons once unsealed. Contact the seller first, using Kinkmarket messages.
• If an item paid in Kredits is not sent. If a seller does not send an item you paid for in Kredits, or you cannot resolve a problem with them, tell us at [email protected] with your order reference and we will look into it. We can hold the seller’s earnings on that order until it is sorted out.

6. Paid directory listings

A basic directory listing is free. Sellers can pay for Featured (£9.99 a month) or Featured Plus (£19.99 a month) to get more visibility. These are monthly subscriptions that renew each month until cancelled, and the Seller terms set out the details.

7. AI creators and AI-generated content

Some creators on Kinkmarket are AI personas rather than real people. That is allowed, and it is always disclosed with an AI label on the profile and listings. Every AI persona has a named, identity-verified person or company behind it who is responsible for it. Where a real creator uses AI to enhance their own photos, the images must still show that same real, verified creator. Our AI policy sets out the full rules. We may label, restrict or remove any account or listing that breaks them.

8. Buyer accounts

A buyer account is free. It lets you message sellers, pay with Kredits, keep your orders in one place and leave feedback. You can sign up with an email and password or with Google.

When you register you confirm that you are 18 or over and that the details you give are accurate. Keep your password private. You are responsible for what happens under your account. If you think someone else has used it, email [email protected] straight away.

You can close your account at any time from your account security settings. Our Privacy policy explains what happens to your data when you do. Any Kredits left in your balance are lost when your account is closed.

9. Messages

Kinkmarket has private messaging between buyers and sellers. Use it to ask questions, agree custom orders and arrange delivery. It is not for sending pornographic content. The rules in these terms and in the Content policy apply in messages just as they do on the rest of the site.

Messages are private to the people in the conversation. We do not routinely read them. We will look at a conversation if one person reports the other, if law enforcement lawfully asks us to, or if we have good reason to think these terms or the Content policy have been broken.

You can block someone or report a conversation from inside it.

10. Acceptable use

You must not:

• use Kinkmarket if you are under 18, or try to get round the age check;
• scrape, copy or access the site by automated means without our permission;
• interfere with how the site works or with its security;
• send or post anything unlawful, abusive, harassing, deceptive or infringing, including in messages;
• send pornographic content through messages;
• pretend to be someone else, or misrepresent who you are, your age or your connection to a seller;
• hold more than one account, or open one for someone else, without our permission;
• use Kinkmarket to arrange payments designed to avoid these terms, or to commit fraud.

11. Reporting content and complaints

If you think anything on Kinkmarket is illegal or breaks our rules, report the conversation from inside it, use our content report form, or email [email protected] with a link and a short description. Reports about anyone who may be under 18, or about other clearly illegal material, are treated as urgent. We aim to deal with every other report within 5 days.

If you want to complain about how we handled a report, about action we took on your account, or about anything else we did, email [email protected]. We will reply and tell you what we decided and why.

12. Suspension and closure

We may remove content, suspend or close an account, or remove a listing if we reasonably believe someone has broken these terms, the Seller terms or our policies, or if the law requires it. For the most serious breaches, including anything in the legal baseline of our Content policy, we act immediately and report to the relevant authorities. Where it is lawful and sensible to do so, we will tell you why.

13. Other websites

Some listings link to sellers’ own websites. We do not run those websites and we are not responsible for them, what they sell, or your dealings with them.

14. Our responsibility to you

We work to keep Kinkmarket safe and accurate, but we cannot promise that every listing is accurate or available, or that the site will always be available without interruption.

We are not responsible for a seller’s items, services or conduct, or for payments you make to a seller outside Kinkmarket. If we are responsible for a loss on a digital purchase you made through Kinkmarket, our total responsibility is limited to what you paid for that purchase.

Nothing in these terms limits or excludes our liability where the law does not allow it, including for death or personal injury caused by our negligence, for fraud, or for your legal rights as a consumer.

15. Changes to these terms

We may update these terms. The date at the top shows when they last changed. If a change significantly affects you, we will tell you by email or on the site before it takes effect. If you keep using Kinkmarket after a change takes effect, the new terms apply.

16. Law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you can also bring a claim in your local courts. Kinkmarket can be reached from abroad, but it is run from the United Kingdom, and if you use it from another country you are responsible for following the laws that apply to you there.
